Disability Tax Credit – What it is and How it Works

Discrimination against persons with impairments and/or people who appear disabled is called disability discrimination. Ableism characterizes those who are defined as disabled by their physical disabilities. Examples include Physician Assistants (PA), which must assist physically disabled patients in clinics; Carpet Cleaners (who often have to lift patients); and Therapists, which often have clinical procedures. There are many other job titles that fall under the definition of disability discrimination. The most common are:

*OCF is the acronym for Out-of–Credentials Functional impairment. It refers to one or more of a normal work environment’s duties. These include being unable or unable to stand for extended periods of time due a physical handicap. A Person with a Limited Strength System (LS), is someone who has limited ability to perform some standard work activities.   • *OCD OCD is an acronym for Oppositional Defiant disorder. It is a mental illness that causes people to reject the rules of society. An example of this is that a person who is unable to wear a suit may be considered disabled, because of their inability to wear a suit. OCD sufferers may avoid certain situations, such interaction with others. This form of discrimination is considered acceptable, in that it does not harm the employee, the business, or anyone else.

*MSD(orum) MSD stands for Multiple Sclerosis Disability, and deals with the central nervous system, causing a decline in the person’s motor abilities. This condition can affect speech, movement, swallowing, hearing and writing. A person with MSD may not have full use of their upper extremities. Some of these limitations can be improved with therapy. This disability can cause poor work placement and increase need for disability benefits.

*Work Injury Certain types of work accidents are considered “work-related” disabilities, meaning that they require particular skill training to do the job. These include those in the automotive, construction, or plumbing industries. While most people can perform the work, many suffer long-term health issues. Some people suffer pain on a consistent basis, while others do not.

Workers’ Compensation: The main benefit to workers’ compensation is that they often allow injured workers to recover their costs. Workers can also sue their employers if they are in an accident at work. As long as they weren’t being unsafe, Workers’ compensation doesn’t cover rehabilitation or prosthetic devices. This is the main drawback. In some cases, the injured worker may have the right to seek monetary benefits from their employer. However, this is often dependent on their insurer.

Social Security Disability Insurance provides financial security for people who have been disabled. Disability insurance pays benefits based on income and other requirements. It is usually only available to those aged 40 or older, but it may be possible for children to get disability insurance. Because this program is rarely used, premiums are extremely low. The policy holder’s disability insurance usually expires at the age of sixty five.

The disability tax credit encourages people with disabilities to return to work. The disability tax credit is also a way to keep the economy growing and gives employers incentives to hire qualified workers. Many people believe the disability tax credit is a type of disability insurance. However, this is false. Employers are encouraged to offer qualified disabled workers employment opportunities by offering disability tax benefits. Individuals may also claim disability tax benefits if they are receiving Social Security disability payments, but they must be applying for employment and can’t claim it for a pre-existing condition.
